2) Breeding fee and other incurred expenses are due when mare is bred and picked up. Mare owner may not pick up mare from breeder's possession until all expenses are paid in full. 3) A non-refundable deposit of $150.00 (one hundred fifty dollars) is due with this contract. 4) Mare care is $8 per day, payable when the mare is picked up. 5) Mare owner agrees to provide stallion owner/agent a copy of the mare's AQHA registration so that the AQHA stallion report is correct. 6) The mare owner agrees to have the mare up to date on her vaccinations, healthy, and in good condition for breeding. A negative Coggin's test, dated within the last six months, is required. 7) The mare should be halter broke and able to be handled from the ground. 8) Please have the mare barefoot. If she is shod, the shoes will be pulled at the owner's expense. 9) If the mare requires veterinary care, whether for breeding or injury, during her stay at the breeder's facility, the mare owner is responsible for all veterinary costs incurred. 10) This contract contains a "Live Foal Guarantee". A live foal is described as a newborn foal that stands and nurses without assistance. If foal is born dead, there are return privileges for the succeeding year only if breeder is notified within 14 days and receives a veterinarian's statement confirming death. If after being pronounced "safe in foal" the mare should miscarry, abort, or prove barren after leaving the breeder's premises, mare owner has the privilege to return her for breeding during the current breeding season or the following year. It is the responsibility of the mare owner to provide proper care for the mare during her pregnancy including 4 ways and Rhino shots during the 5th, 7th, and 9th month of pregnancy. Foal abortion or stillborn foals due to neglect or caused by Rhino will make the Live Foal Guarantee null and void. 11) A "Breeder's Certificate" will be issued for the foal, conceived by the mating, only after the mare owner has notified the stallion owner that the said mare has produced a live foal and all expenses have been paid in full. 12) Mare owner agrees that the breeder, their agents, or employees are not liable for death, sickness, disease, and/or accident including consequential damages caused to the mare and/or foal. Mare owner will likewise not be responsible for any death, sickness, disease, and/or accident including consequential damages caused to the stallion. 13) When mare owner signs this contract it will be binding on both parties, subject to the above terms and conditions. This contract represents the entire agreement between the parties. No other agreements or promises, either verbal or implied are included unless specifically stated in writing and signed by both parties. This contract is non-transferable or assignable.
